Connecticut workers compensation commission requirements mandate most businesses to provide workers compensation coverage to their employees. However, state labor laws and regulations outline specific exceptions and exemptions. Below, we explore the types of businesses that may be exempt from obtaining workers compensation coverage:
While sole proprietors and partners are generally not required to have workers compensation insurance for themselves, some exceptions apply. For example, if a construction contractor partners with an entity that employs workers, the partnership may need to provide coverage for those workers.
In an LLC, members may be exempt from workers compensation CT if they are considered "excluded members." Excluded members typically do not participate in the day-to-day operations of the business. However, if an excluded member becomes involved in the business's operations, they may no longer qualify for this exemption.
Corporate officers, such as presidents, vice presidents, and directors, may be exempt from workers compensation CT if they meet specific criteria. These criteria typically include ownership stakes in the company and the nature of their roles. However, officers who do not meet these criteria may need to be covered.
Some non-profit organizations with low annual payroll expenses may qualify for exemptions from workers compensation CT. Eligibility criteria are determined based on the organization's size and the nature of its activities.
Domestic workers, including housekeepers, nannies, and caregivers, are often exempt from workers compensation CT requirements. Similarly, casual employees hired for sporadic or occasional tasks may not require coverage.
While many agricultural laborers are exempt, there are certain conditions under which they may need workers compensation coverage. For instance, agricultural employers with five or more full-time employees or 12 or more part-time employees must provide coverage.
Connecticut workers compensation insurance provides essential financial support to employees who suffer work-related injuries or illnesses. The benefits employees receive are determined by various factors, including the nature of their injuries, their ability to work, and the extent of their disabilities. Here are the specific amounts:
Temporary Partial Disability Benefits are designed to compensate employees who can work in a limited capacity while recovering from a work-related injury. In Connecticut, TPD benefits are 75% of the difference between the injured employee's average weekly wage before the injury and their current earnings while on limited duty. The Connecticut Workers Compensation Commission sets the maximum TPD rate annually, ensuring injured workers receive fair compensation during recovery.
Temporary Total Disability Benefits are provided to employees who cannot work due to work-related injuries. In Connecticut, TTD benefits are 75% of the injured employee's average weekly wage before the injury. The maximum TTD rate is also determined annually by the Workers Compensation Commission to ensure that injured employees receive appropriate financial support during their recovery.
Permanent Partial Disability Benefits are awarded to employees who suffer permanent impairments due to work-related injuries or illnesses. The specific amount of PPD benefits depends on the nature and extent of the disability, as determined by a medical evaluation. These benefits are calculated based on a statutory schedule that assigns a specific number of weeks of compensation for each type of disability.
Permanent Total Disability Benefits are provided to employees who cannot work due to work-related injuries or illnesses. In Connecticut, PTD benefits are 75% of the injured employee's average weekly wage before the injury, subject to statutory maximums. These benefits are essential to support individuals whose injuries have left them permanently disabled and unable to earn a living.
Connecticut workers compensation insurance provides crucial financial assistance to employees who suffer job-related injuries or illnesses. However, employees may wonder how long it takes to receive these essential benefits. Let's explore the waiting periods and the timeline employees can expect before they receive workers compensation benefits:
The first step in the workers compensation process is reporting the injury promptly to the employer. Connecticut workers compensation laws require employees to report work-related injuries or illnesses to their employers within a specific timeframe, typically within five days of the incident or as soon as reasonably possible. Failure to report the injury promptly can impact the eligibility for benefits.
After receiving notice of the injury, the employer is responsible for promptly notifying their workers compensation insurance carrier. This action initiates the claims process. Employers must also provide injured employees with the necessary forms to document the injury and medical treatment.
Injured employees must seek immediate medical attention for their injuries. Connecticut workers compensation insurance generally covers medical expenses related to the injury. The timeline for this step largely depends on the availability of medical care and appointments.
Connecticut workers compensation insurance typically has a waiting period before wage replacement benefits, such as Temporary Total Disability Benefits (TTD), become payable. Under state law, this waiting period is seven calendar days from the date of disability. The injured employee may use sick leave, vacation time, or any other paid time off to cover their lost wages.
If the employee's disability lasts longer than the initial seven-day waiting period, workers compensation CT laws allow for retroactive payment of TTD benefits. This means that once the waiting period is over, the injured employee should receive compensation for the initial seven days of disability.
The speed at which employees receive benefits also depends on the timely processing of their workers compensation claims. Employers and insurance carriers are responsible for handling and processing claims promptly to ensure employees receive benefits.
Failure to purchase workers compensation insurance in Connecticut can result in significant penalties for both businesses and employees. It is essential to understand the specific consequences outlined in Connecticut workers compensation CT laws:
Fines and civil penalties: Employers who do not provide workers compensation insurance as required by Connecticut workers compensation requirements may be subject to substantial fines and civil penalties. These fines can vary depending on the nature and duration of non-compliance.
Criminal penalties: In cases of willful non-compliance or fraud related to workers compensation coverage, employers may face criminal charges. These charges can lead to imprisonment and additional fines. Employers should be aware that Connecticut workers compensation laws are strictly enforced to deter fraudulent activities.
Liability for employee claims: Employers who fail to provide workers compensation insurance are also at risk of being held personally liable for any claims filed by injured employees. This means the employer may be responsible for covering the injured employee's medical expenses and lost wages out of pocket.
Loss of defenses: Non-compliant employers may lose certain legal defenses in the event of a workplace injury lawsuit. This can leave employers vulnerable to significant financial liabilities and legal challenges.
Loss of benefits: Injured employees who knowingly misrepresent or provide false information regarding their injuries or the circumstances of their injuries may face penalties. This can result in the loss of workers compensation benefits to which they would otherwise be entitled.
Legal consequences: Employees who engage in fraudulent activities related to workers compensation claims may also face legal consequences, including fines and potential criminal charges.

Use anyone except Employers. Period. They are non-transparent and shameful. After I complained long enough to warrant a call from a supervisor, the supervisor called back from a PRIVATE NUMBER (no caller ID), left a message that they are not reversing their decision (without any communication with me), and failed to leave a phone number for me to call back. She was hiding! They also fact find via email and phone calls, which is terrific for speed and communication. However, after setting a precedence of email or phone calls, they send time sensitive information via email, without any heads up... they are hoping you miss it and forfeit via expiration. Evil policies. Go elsewhere.
This place is an absolute joke of a company and should be ashamed of the way they conduct business. I was hurt on the job at the end of July and it took them just shy of 7 weeks to issue out a paycheck to me. Yes the amount was back dated but still. Not many have the luxury of not receiving a paycheck for almost 2 months. To top it all off, the original adjuster marked me down for the wrong state which caused a problem from the get go, I've had 3 different adjusters now since each one can't seem to figure out the simplicity of my claim. All my paperwork which includes, my job, house, and drs visits all are from the same state and city but yet some how I have been filed under a completely different state 1500 miles away. They do not answer your phone calls or emails no matter how many you leave. I've had to escalate my frustrations to the supervisors of each of these individuals in order to even get some kind of response. I've had more communication and information given to me about my claim from the customer service representatives then the actual adjusters.......... please tell me how that works?! A serious overhaul needs to happen here in order to serve your clients the way they deserve to be taken care of. 10/10 do not recommend this company to a single soul on earth
I have never had the displeasure of working with a more incompetent and disrespectful person in my life. I’m an injured worker and the adjuster that was assigned to my case was named Carrie Furgeson. In the past 6 weeks that I’ve been injured and out of work I have only been able to get ahold of her twice, not for lack of trying. I have left countless voicemails, countless emails, and she ignores them all. When I am finally able to get ahold of her I’m greeted with terrible customer service. She is rude, she talks over me and I’m hardly able to get a word in edgewise. She spelled my name wrong on my documents even after I spelled it for her properly countless times, this caused a whole new issue with my bank. I have bill collectors from the hospital calling me demanding payment and Carrie Furgeson won’t do a single thing to help, or to get them paid. All of my documentation is in Colorado, my job is in Colorado, my address is in Colorado, all my Dr offices and appointments have been in Colorado and Carrie still managed to hold my claim because she wasn’t sure what state she needed to file it under. It’s been 6 weeks since my Injury and my company still hasn’t received the wage paperwork to fill out so they can get me my correct wages. When she’s not ignoring me she’s answering my questions with “I don’t know” well I don’t know how she got this job, because apparently she doesn’t know anything about it. She is a disgusting morose individual inside and out and I genuinely wish her the worst in all of her future endeavors. I highly recommend you don’t use this company. Please if you are a business owner and your looking into this company please don’t use them. I’m sure they have the cheapest payment and that’s why companies use them in the first place, but you will be doing your employees a grave disservice by forcing them to venture into this absolute dumpster fire of a company. I would rate 0/5 if possible but 1 was the lowest I was allowed.
