s an immigration consultant, you are expected to help clients looking to relocate from one country to another. Just like a legal consultant or management consultant, you work through a minefield of paperwork and a host of ever-changing legislation.
Given the nature of your work, it doesn't take much to hamper a smooth immigration process. Your client's documents could go missing, or you could make mistakes with their paperwork. A mistake on your part could cost the client a favorable outcome. To make matters worse, as it stands, the Immigration Act of 2014 makes it impossible to appeal.
In such a circumstance, it wouldn't be too farfetched to go all out and claim that a blame game will ensue. Emotions are likely running high, and you might find yourself being accused of negligence or failure to fulfill your professional duty.
While you could rely on your reputation to help you navigate these murky waters, there's a likelihood that the client might seek compensation for what they've invested into the immigration process. In this circumstance, you want to have someone fighting in your corner. That's where immigration consultant insurance comes in.
Getting immigration consultant insurance protects your work, your reputation as an immigration consultant, and your bank balance when mistakes inevitably happen. Once the claim is filed, it's in the hands of your insurance provider of choice. You no longer have to worry over defending yourself, paying your legal team, or paying out of pocket for any compensation or damages.
In today's litigious environment, it is no longer a question of whether or not you need immigration consultant insurance. Seeing as mistakes will inevitably occur, you want to stay proactive about covering yourself as best as possible.
General liability insurance is the first immigration consultant liability insurance you must purchase. This policy protects you against claims made regarding your legal liability for damage or injury suffered by a third party. Insurers will often also include product liability insurance as part of the general liability policy you purchase. General liability insurance immigration consultants, engineering consultants, and lactation consultants further grants protection against claims for slander, copyright infringement, and libel.
The other immigration consultant liability insurance you must purchase is employers' liability insurance for immigration consultants, environmental consultants, and other consultants. This policy protects you and the consultancy from claims made against you by your employees, citing that you are responsible for the death, disease, or injury sustained by the employee.
Professional indemnity insurance for immigration consultants, education consultants, and HR consultants protects you against claims of a breach or alleged breach of professional duty. This policy also meets any costs of awards against you and legal defense. Unlike general liability insurance, this policy only responds to claims filed against your immigration consultancy during the policy year.
Note that the limit of indemnity under your professional indemnity insurance is often capped at the maximum limit of the insurance provider's liability under the policy. This is subject to whether the policy is on an aggregate or independent basis. You want your opinion of the risks to which you are exposed to guide your choice on the amount of professional indemnity insurance policy to purchase.
It is prudent to mention that you can purchase a run-off professional indemnity insurance policy. This policy protects you and the immigration consultancy firm from future claims with respect to work you might have done in the past. This run-off policy is particularly handy if you intend to retire or sell your immigration consultancy business.
Overall, the professional indemnity insurance covers:
Data loss
Negligence
Misrepresentation
Abuse of intellectual property
Defamation

As an independent immigration consultant, you are likely looking for cost-effective and comprehensive coverage. That's where business owner's policy (BOP) for immigration consultants, safety consultants, and business consultants comes in. It provides you with the opportunity to bundle your general liability insurance policy and property insurance policy. This two-in-one policy protects against third-party liabilities and property damage or loss. Even the most basic policy will cover risks, including:
Customer injuries and property damage
Damage to business property
Slander and other related offenses
Note that for your business to be eligible for a BOP, it needs to:
Have fewer than 100 employees
Need less than 12 months of business interruption insurance
Make less than $1 million in annual revenue
Run the consultancy from a small office or workspace
Even in a relatively low-risk field like immigration consulting, most states mandate that you get workers' compensation insurance. Your employees are still susceptible to injuries from slip-and-fall accidents and repetitive motion, among others. If any of these were to occur, your business would be exposed to both legal and financial ramifications that might result in insolvency and, even worse, business closure.
Investing in a workers' compensation insurance policy for immigration consultants, construction consultants, and sleep consultants means you are covered in three primary areas. These include:
Employee injury and death lawsuits
State law compliance
Employee work injury expenses
If you run your immigration consultancy business in Ohio, Washington, Wyoming, or North Dakota, you will be required to purchase workers' compensation insurance through a monopolistic state fund. This means that it might likely not include the employer's liability insurance. However, if you purchase the policy from a private insurance provider, you could potentially fill this gap.
Further, as an SME, you are a prime target for cyber threat actors. They are counting on your IT budget and workforce being limited. That way, they can easily get access to your IT ecosystem and compromise your data or that of your clients.
Imagine a situation in which cyber criminals manage to steal the social security number or credit card information belonging to your clients. If any of this personal information is used in malicious means, there's a likelihood that your clients will file a claim.
That's where cyber liability insurance for immigration consultants, IT consultants, and marketing consultants comes in. It caters for:
Legal costs from a client's lawsuit
Fraud monitoring on affected accounts
Customer notification and follow-up expenses
As you purchase cyber liability insurance, you want to ensure that the policy includes both first- and third-party cyber liabilities. The first-party cyber liability insurance will cover all costs of data breaches to your own IT infrastructure. It pays for the expenses of notifying clients or customers of the breach, the cost of monitoring services for affected clients, and cyber extortion demands, including ransoms.
Third-party cyber liability insurance covers you in the event that a data breach of a client is believed to originate from you. Suppose a client's credit card information lands in the wrong hands due to a leak in your IT infrastructure, and they are defrauded of their money; It is quite probable that they will sue you. The third-party cyber liability insurance coverage pays for:
Attorney fees
Court costs
Settlements, fines, or judgments

This place is an absolute joke of a company and should be ashamed of the way they conduct business. I was hurt on the job at the end of July and it took them just shy of 7 weeks to issue out a paycheck to me. Yes the amount was back dated but still. Not many have the luxury of not receiving a paycheck for almost 2 months. To top it all off, the original adjuster marked me down for the wrong state which caused a problem from the get go, I've had 3 different adjusters now since each one can't seem to figure out the simplicity of my claim. All my paperwork which includes, my job, house, and drs visits all are from the same state and city but yet some how I have been filed under a completely different state 1500 miles away. They do not answer your phone calls or emails no matter how many you leave. I've had to escalate my frustrations to the supervisors of each of these individuals in order to even get some kind of response. I've had more communication and information given to me about my claim from the customer service representatives then the actual adjusters.......... please tell me how that works?! A serious overhaul needs to happen here in order to serve your clients the way they deserve to be taken care of. 10/10 do not recommend this company to a single soul on earth
I have never had the displeasure of working with a more incompetent and disrespectful person in my life. I’m an injured worker and the adjuster that was assigned to my case was named Carrie Furgeson. In the past 6 weeks that I’ve been injured and out of work I have only been able to get ahold of her twice, not for lack of trying. I have left countless voicemails, countless emails, and she ignores them all. When I am finally able to get ahold of her I’m greeted with terrible customer service. She is rude, she talks over me and I’m hardly able to get a word in edgewise. She spelled my name wrong on my documents even after I spelled it for her properly countless times, this caused a whole new issue with my bank. I have bill collectors from the hospital calling me demanding payment and Carrie Furgeson won’t do a single thing to help, or to get them paid. All of my documentation is in Colorado, my job is in Colorado, my address is in Colorado, all my Dr offices and appointments have been in Colorado and Carrie still managed to hold my claim because she wasn’t sure what state she needed to file it under. It’s been 6 weeks since my Injury and my company still hasn’t received the wage paperwork to fill out so they can get me my correct wages. When she’s not ignoring me she’s answering my questions with “I don’t know” well I don’t know how she got this job, because apparently she doesn’t know anything about it. She is a disgusting morose individual inside and out and I genuinely wish her the worst in all of her future endeavors. I highly recommend you don’t use this company. Please if you are a business owner and your looking into this company please don’t use them. I’m sure they have the cheapest payment and that’s why companies use them in the first place, but you will be doing your employees a grave disservice by forcing them to venture into this absolute dumpster fire of a company. I would rate 0/5 if possible but 1 was the lowest I was allowed.
